This document, "Attachment #1 - Terms and Conditions," provides the comprehensive terms and conditions that will govern any order awarded as a result of the solicitation. It supersedes all other terms and conditions and acceptance of an order signifies acceptance of these terms.

• Provisions: Includes FAR clauses such as 52.212-1 (Instructions to Offerors), 52.212-2 (Evaluation), and 52.240-90 (Security Prohibitions and Exclusions).
• Evaluation Criteria: Award will be made to the lowest priced, technically acceptable offeror. Technical acceptability is determined by the ability to provide new manufactured commercial items with clear traceability to an approved manufacturer. "New Surplus" items require approval and photos. Only the lowest priced offer is evaluated for technical acceptability; if not acceptable, the next lowest priced offer is evaluated.
• FAR Clauses Incorporated by Reference: A significant number of FAR clauses are incorporated by reference, covering areas such as:
  • Prohibitions on contracting with entities requiring internal confidentiality agreements.
  • System for Award Management (SAM) registration and maintenance.
  • Protection of government interests when subcontracting with debarred or suspended contractors.
  • Prohibition on contracting with inverted domestic corporations.
  • Terms and Conditions for Commercial Products and Commercial Services.
  • Small business set-aside notices and subcontracting plans.
  • Post-award small business program representation.
  • Convict labor, child labor, equal opportunity for veterans and workers with disabilities.
  • Combating trafficking in persons.
  • Buy American and Trade Agreements.
  • Tax on certain foreign procurements.
  • Payment terms and electronic funds transfer.
  • Applicable law for breach of contract claims.
  • Sustainable products and services.
  • Security prohibitions and exclusions (including those related to China, Iran, and Sudan).
• Quality Assurance: Applicable to orders for products touching USCG aircraft, requiring immediate notification of any non-conformities, supply changes, or potential issues. Contractor's quality control manual must address risk management, testing, and inspection processes.
• Packaging and Shipping Instructions: Specific requirements for packing materials (prohibiting popcorn, shredded paper, Styrofoam, peanut packaging) and labeling for shipment to the USCG Aviation Logistics Center.
• Inspection and Acceptance: Performed at destination, requiring a Certificate of Conformance (COC) and full traceability. F.O.B. Destination is the requested delivery term.
• Invoicing Instructions: Requirements for submitting invoices, including SAM active status and electronic payment.
• Option for Increased Quantity: The USCG may order an additional quantity of eight (8) items, up to a maximum of sixteen (16) total, at the same price and lead time within 365 days of award.
