Justification
The sole-source determination is based on Virginia Code § 18.2-494, which mandates that only the legal owner of a liquefied petroleum gas (LP) container, or a supplier explicitly authorized in writing by that owner, may fill, refill, deliver, or otherwise service that container. Since AmeriGas Propane L.P. owns and marks the propane tanks on MCB Quantico, they are the only entity legally permitted to service these tanks, creating a legally mandated sole-source environment. AmeriGas Propane L.P. has confirmed their proprietary rights and status as the sole authorized provider.
Additional Notes
At present, there are no plans to compete future contracts for this requirement due to the existing statutory and ownership barriers. However, the Facilities Management Branch (FMB) will assess future competition if new potential sources emerge.
