PTAG 6.1.1 Notice of Intent for Sole Source
The mission of the USPTO is to foster innovation, competitiveness and economic growth, domestically and abroad, by delivering high quality and timely examination of patent and trademark applications, guiding domestic and international intellectual property policy, and delivering intellectual property information and education worldwide. The Office of the Under Secretary and Director (OUS) supports the Under Secretary of Commerce for Intellectual Property and Director of USPTO, who is the principal advisor to the President of the United States and the administration, through the Secretary of Commerce, on all intellectual property policy matters. The Director also serves as the chief executive of the USPTO, ensuring that the agency achieves its strategic and management goals.
Mr. Richard McCormack is required to perform strategic writing and editing work related to USPTO correspondence, documents and other written material which may cover complex or controversial subject matters.
For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C.2(b)(4)(A). The USPTO intends to negotiate and award a Purchase Order for Speech Writing Services under All Other Support Services- NAICS Code 561990 –for an estimated period of performance comprised of up to six (6) months. The anticipated award date is January 23, 2026.
For this instance, Mr. McCormack is the only known qualified source since he is a speechwriter with experience writing at the executive-level and having expert knowledge in both patent and intellectual property (IP) domains who possesses both professional speechwriting capability and deep, working knowledge of patent law and intellectual property systems including technical and legal topics in content development, editing, proofreading and revision to ensure accuracy, clarity and consistency for speechwriting for the OUS and Director of the USPTO.
It is the best interest of the Government and consistent with USPTO’s statutory authority to proceed with this strategic writer and editor.
