It explains why the U.S. Coast Guard intends to award a purchase order on a brand name basis to the original equipment manufacturer (OEM), Tronair, INC.

• Rationale: The items are highly specialized, designed and manufactured by Tronair, INC. Tronair owns all rights to the technical data, specifications, and drawings. The government does not own these rights and it is determined to be uneconomical to purchase them or to develop the technical data to create an adequate purchase description for other manufacturers. The items require critical safety, durability, and reliability, necessitating extensive and/or sophisticated testing.

This document indicates that the procurement is restricted to a specific brand name (Tronair, INC.) due to proprietary technical data and the specialized nature of the items. Potential bidders who are not the OEM or an approved OEM source may find this opportunity not applicable unless they can provide equivalent items that meet the stringent requirements and the government determines it is feasible to acquire them from a source other than the OEM.
