• Offerors must provide a Certificate of Conformance (COC) for all items, including National Stock Number, Part Number, Serial Number, and Purchase Order Number, signed by an authorized representative.

• The period for acceptance of offers is 60 calendar days from the date specified for receipt of offers, unless otherwise stated.

• Delivery is required sixty (60) days After Receipt of Order (ARO). Early and/or partial deliveries are desired and will be accepted.

• Offers must be submitted by the exact time specified in the solicitation and include the solicitation number, offeror's name and address, UEI, EFT indicator, information for evaluation, responses to required provisions, and a statement of agreement with terms and conditions.

• Award will be made to the lowest priced, technically acceptable offeror representing the best value to the Government.

• Technical Acceptability will be evaluated to determine an overall rating of "acceptable" or "unacceptable," based on the ability to provide new manufactured commercial items from the OEM or an OEM-approved source.

• Only brand-name items requested will be considered for award.

• The evaluation method prioritizes the lowest priced offer for Technical Acceptability. If the lowest priced offer is not acceptable, the process continues with the next lowest priced offer.

• The solicitation specifies brand-name items and requires traceability to the OEM.

• The document includes numerous FAR and HSAR clauses, including those related to security prohibitions and exclusions, trade agreements, and payment procedures.

• Offerors must review and comply with all incorporated provisions and clauses, many of which are incorporated by reference.

Justification for Other Than Full and Open Competition

This document justifies the U.S. Coast Guard's intent to purchase specific items on a brand name basis directly from the Original Equipment Manufacturer (OEM), LIFESAVING SYSTEM LLC. The items are "PKT, MOLLE, RADIO, CLP" (Part Number: 745-P19-2), with an initial quantity of 300. These are molle radio pockets designed for use with molle vests for Search and Rescue (SAR) operations.

The justification is based on the "Brand Name" type, indicating that the items are peculiar to one manufacturer and essential to the Government's requirements. LIFESAVING SYSTEM LLC is the OEM, owning all rights to the technical data, specifications, and drawings necessary for manufacture. The Government does not own these rights and has determined it would be uneconomical to purchase them or to develop the technical data required to create an adequate purchase description or reverse engineer the item. The items require extensive testing to meet critical safety, durability, and reliability requirements.
