Justification for Sole Source
This award was made as an exception to fair opportunity under FAR 16.505(b)(2)(i)(B). The VA leveraged the DoD TRANSCOM IDIQ GWAC contract (HTC711-23-D-C025) with UPS, which is designated as a "Best-in-Class" mandatory solution for package delivery services per OMB Memorandum M-17-29 and VA Directive #7179. Market research, including an RFI and Sources Sought notice, was conducted to assess small business participation. However, the "VA Rule of Two" and "SBA Rule of Two" could not be met, as no suitable Service-Disabled Veteran-Owned Small Business (SDVOSB) or Veteran-Owned Small Business (VOSB) concerns were identified that could provide the required services without significant risk of delays or disruptions to patient care. UPS was determined to offer the best overall value for Next Day and Residential Ground service in the region, with superior guarantees, specialized handling, and cost-effectiveness compared to other Next Generation Delivery Service (NGDS) GWAC vendors.
