This document is a Sources Sought Notice, which serves as a market research tool to identify potential Indian Small Business Economic Enterprises (ISBEEs) and Indian Economic Enterprises (IEE) capable of performing a requirement for the Northern Cheyenne Service Unit (NCSU). It is not a solicitation for proposals.

• Requirement: Biweekly removal, transport, treatment, and final disposal of all regulated medical waste, including contaminated sharps, for NCSU.

• PSC Code: F108 - Environmental Systems Protection – Environment Remediation.

• Size Standard: $47.0 Million

• Duration: Base Year plus Four Option Years (60 months).

• Buy Indian Act Preference: The government intends to use the Buy Indian Act to give preference to IEEs.

• Definition of IEE: Includes requirements for at least 51% ownership and earnings from the contract by Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, and control of management and daily business operations by one or more Indians.

• Interested parties, particularly ISBEEs and IEEs, are encouraged to respond.

• Responses must include a capability statement demonstrating the company's ability to perform the services and meet the IEE definition.

• Specific demonstration points include:

  • Responsibility for permits, licenses, and fees.
  • Compliance with federal, state, tribal, and local laws.
  • Meeting the IEE definition (51% ownership/earnings, Indian control).
  • How earnings will be distributed, especially in partnerships.

• A "Buy Indian Act Indian Economic Enterprise Representation Form" (Attachment B) must be submitted.

• The submission deadline is March 9, 2026, at 3:00 pm MST.

• Responses will help determine the acquisition strategy.

This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Criteria: Offerors must certify that their enterprise meets the definition of an "Indian Economic Enterprise" throughout the solicitation response period, contract award, and the full contract performance period.
• Notification Requirement: Contractors must immediately notify the Contracting Officer if they no longer meet eligibility requirements.
• Documentation: Contracting Officers may request documentation of eligibility.
• Registration: Successful offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law and subject to penalties.
• Representation Section: Offerors must check a box to indicate if they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, UEI SAM Number, Certifying Signature, and Print Name.

This form is critical for bidders seeking to participate in opportunities designated under the Buy Indian Act. Bidders must accurately complete and submit this form to self-certify their eligibility. Failure to meet the criteria or provide accurate information can lead to disqualification or penalties.

Statement of Work (SOW)

To ensure the proper segregation, packaging, labeling, transport, treatment, and disposal of Regulated Medical Waste (RMW) generated by the Northern Cheyenne Service Unit (NCSU) healthcare facility, maintaining compliance with federal and state regulations and supporting the Indian Health Service mission.

• Biweekly (every 14 days) removal, transport, treatment, and final disposal of RMW, including contaminated sharps.

• Supply NCSU with RMW containers and associated hardware, compliant with DOT and ANSI regulations.

• Provide sufficient containers for an estimated 255 pounds of RMW and 25 sharps containers per month.

• Replace used containers at each scheduled pickup.

• Remove and properly dispose of all regulated medical waste generated by the facility.

• Qualified vendor to remove, transport, and discard or destroy used sharp instruments (needles, scalpels, etc.).

• Services to be performed during normal Government business hours (Monday-Friday, 8:00 a.m. - 4:30 p.m. MST), excluding Federal holidays.

• If a pickup falls on a Federal holiday, services will be performed on the next Government business day without additional cost.

• Manifest to be completed at time of service.

• Place of Performance: 420 N. Cheyenne Avenue, Lame Deer, Montana, 59043.

• Period of Performance: One-year base period (04/01/2026 – 03/31/2027) plus four one-year option periods (through 03/31/2031).

• Compliance with EPA, Montana DEQ, and US DOT regulations for RMW transportation and disposal.

• Vendor shall perform first pick-up within 14 days of award.

• Containers and hardware to be supplied within 14 days of award.

• Necessary hardware for mounting/securing containers to be supplied within 30 days of award.

• No IT or facility clearances are needed.
