Eligibility / Set-Aside
This acquisition is being pursued on a sole source basis in accordance with 41 U.S.C. 3304(a)(1), which exempts it from full and open competition. The justification states that only Agilent Technologies, as the original manufacturer, is authorized and trained to perform these services, which require access to proprietary data. Using another vendor could lead to improper handling, instrument damage, and potential warranty issues.
Submission & Evaluation
This notice is NOT a request for proposal. However, the Government will consider all capability statements received by the deadline for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to open the requirement to competition based on responses is solely at their discretion. The Contracting Officer will ensure the price is fair and reasonable before placing an order.
Additional Notes
Market research indicated that technical capability and proprietary ownership were the determining factors for this sole source justification. The justification will be made available on SAM.gov for orders exceeding $25,000.
