Statement of Work (SOW) / Performance Work Statement (PWS)

This Performance Work Statement (PWS) outlines the requirements for providing service, repair, and/or replacement of Overhead Crane Hoists units on Fort Drum, NY. The service must be completed in accordance with current statutory regulations and must have the capability to be surged in the event of a national emergency, with new pricing to be negotiated for surge periods.

• Provide all necessary resources for service, repair, and/or replacement of Overhead Crane Hoists.

• Work must adhere to current statutory regulations.

• Capability for surge operations in a national emergency.

• Contractor operating hours must be consistent with normal core duty hours of Fort Drum (7:30 AM - 4:00 PM, Monday through Friday, excluding Government holidays), unless otherwise directed.

• Reimbursement may be required for government costs of inspecting work performed outside normal hours.

• Services are to be performed on Fort Drum, NY.

• Contractor Personnel: Must be trained, qualified, certified, and/or licensed. Records must be maintained and provided upon request. Personnel must be able to speak, read, write, and understand English. Must be physically capable of performing work in all climatic conditions. Specialized qualifications are listed as N/A.

• Employee Conduct: Prohibits employees under the influence of alcohol or controlled substances. Must comply with all applicable federal, state, local, and Fort Drum laws and regulations. Violation may result in removal from the work site or denial of access.

• Employee Appearance: Must be appropriately dressed, including any necessary personal protective clothing and equipment.

• Personnel Constraints/Conflicts of Interest: Must not hire individuals whose employment would result in a conflict of interest or is prohibited by DoD Regulation 5500.7-R.

• Personnel Safety: Contractor is responsible for all safety precautions and programs, complying with all applicable federal, state, local, and Fort Drum laws and regulations. Must immediately stop work and notify authorities if hazardous material is encountered.

• Serious Accident and Incident Reporting: Must report serious accidents and incidents within one hour to the Directorate of Emergency Services, Safety Office, and Contracting Officer.

• Claims Liability: Contractor must indemnify and save harmless the Government from all claims, damages, actions, debts, liabilities, and attorney fees arising out of the work.

• Security, Installation Access and Control, and Training: All contractor employees requiring access must complete Anti-terrorism (AT) Level I training within 30 days. Must comply with installation access control policies and procedures, including providing required documentation for background checks and obtaining DoD identification credentials or temporary passes. Failure to comply may result in denial of access and will not excuse timely performance.

• iWATCH Training: Employees must be briefed on the local iWATCH program within 30 days of contract award.

• OPSEC Training: Employees requiring access must complete OPSEC Level I training within 30 days of contract start.

• Environmental Compliance: Must comply with all federal, state, and local regulations covering environmental protection. Must adhere to Fort Drum's Environmental Management System (EMS) and ISO 14001:2004 standards. Must use sustainable acquisition products. Must comply with regulations regarding wetlands and biological resources (fish and wildlife), including specific measures for Indiana bats and threatened northern long-eared bats. Pesticide usage must comply with all applicable regulations.

• Toxic/Hazardous Material and Waste Management: Must comply with regulations for solid waste disposal, hazardous materials inventory, and hazardous waste management. Must notify authorities of potential presence of lead, cadmium, chromium, and lead in painted surfaces and dust.

• Reports: Contractor must complete reports and requests for information in a timely manner. Contractor Manpower Reporting is required via a secure data collection site.

• Quality Control Plan (QCP): Contractor must maintain an inspection system acceptable to the Government and submit its QCP upon request.

• OSHA: All work must conform to applicable OSHA Standards. Safety rules must be effectively carried out.

• Definitions and Acronyms: Specific definitions and acronyms relevant to the PWS are provided.

• Government Furnished Resources: Describes items furnished by the Government, including emergency medical treatment, fire protection, and police protection/law enforcement services. No government-furnished supplies, property, or facilities are provided.

• Contractor-Furnished Items and Services: Contractor shall furnish all supplies, equipment, supervision, materials, and services not identified as government-furnished. Must obtain all necessary permits, licenses, and comply with all applicable laws and regulations. Contractor-owned property must be in operable condition and meet all requirements. Equipment must be marked as Contractor Owned. Vehicles must be marked with the Contractor's name. Contractor-owned equipment must be operated according to applicable laws and regulations.

• Minimum Insurance Requirements: Specific minimum insurance amounts are required for NYS Workmen's Compensation, Employer's Liability, General Liability for Bodily Injury, and Automobile Liability.
