Justification & Evaluation
The Government intends to negotiate with Frank GmbH on a sole-source basis under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.103-1. This is due to Frank GmbH being the only company capable of ensuring continuity for USAG Bavaria's mission without a lapse in coverage, given the breadth, complexity, and urgency of the requirement. It would be cost and schedule prohibitive for any other contractor to transition and ensure continuity. This is not a request for competitive proposals. However, all responsible sources may submit a capability statement, which the Government will consider to determine if competition is feasible.
