Terms and Conditions

• Instructions to Offerors (52.212-1): Offerors must complete the "Requirement" document (Attachment 1) with unit prices. Offerors agree to hold prices firm for 60 calendar days from the offer receipt date.

• Evaluation (52.212-2): This provision is not applicable. Quotes will be evaluated based on Federal Acquisition Regulation (FAR) 12 criteria. Award will be made to the lowest priced offeror rated technically acceptable. Only the lowest priced offer will be evaluated for Technical Acceptability; if unacceptable, the process continues to the next lowest priced offer.

  • Technical Acceptability: Evaluated as "acceptable" or "unacceptable" based on the offeror's ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source. Exact part numbers must be listed on the requirements schedule.

• Price Evaluation: Prices will be evaluated for fairness and reasonableness. Quantity price discounts and prompt payment discounts should be included.

• Full Text Provisions: Includes certifications regarding responsibility matters (52.209-5), delinquent tax liability or felony conviction (52.209-11), service of protest (52.233-2), and security prohibitions and exclusions (52.240-90), including restrictions related to Sudan and Iran, and prohibitions on certain telecommunications equipment and services.

• Quality Assurance: Applicable to orders for products that will touch USCG aircraft. Requires immediate notification of any event, supply change, material change, defect, or non-airworthy condition. The Government reserves the right to inspect non-conforming products. Contractor's quality control manual must address risk management, testing, inspection, and counterfeit/suspect parts processes. Changes impacting the product require USCG approval.

• Packaging, Marking, and Shipping Instructions: Specific requirements are detailed for packaging materials, labeling of individual containers, and marking of shipping containers. Shipments are to the USCG Aviation Logistics Center.

• Inspection and Acceptance: Performed at destination by local USCG personnel. A Certificate of Conformance (COC) is required for all items, signed by an authorized official, specifying nomenclature, part number, and date of manufacture. Full and clear traceability must be provided.

• Deliveries/Performance: F.O.B. Destination is requested.

• Invoicing Instructions: Invoices to be submitted IAW FAR 52.212-4 to the designated billing office, with electronic submission highly encouraged.

• Sustainable Products and Services (52.223-23): Requirements for products containing recovered material, energy/water-efficient products, biobased products, and acceptable chemicals/products/processes.
