Justification
The Government intends to solicit and negotiate with Spectra Technologies, LLC on a sole-source basis under the authority of 10 U.S.C. § 4022(f)(2). This allows for a follow-on production contract without competitive procedures when competitive procedures were used for the prototype project. NSWC Crane awarded an Other Transaction Agreement (Agreement Number N001642490003) to Spectra Technologies, LLC on September 9, 2024, for the prototype. The Government states that only Spectra Technologies, LLC possesses the unique knowledge and ability to manufacture and deliver these requirements, as they developed the prototype, and other industry sources lack the necessary expertise to provide an alternate solution in a timely and cost-effective manner.
Response & Submission
All responsible sources may submit a capability statement for consideration. However, the Government explicitly states that a determination not to compete this action based on responses is solely at its discretion. Information received will primarily be used to determine if a competitive procurement is feasible.
