This document is the "Indian Economic Enterprise Representation Form" required for the "Buy Indian Act." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" (IEE) as defined by HHSAR 326.601, in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Period: Offerors must meet the IEE definition at the time of offer, contract award, and throughout the contract performance period. Any change in eligibility requires immediate notification to the Contracting Officer.
• Documentation: Contracting Officers may request documentation of eligibility before awarding set-aside or sole source contracts under the Buy Indian Act.
• Registration: Successful Offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
• Representation Section: Requires the offeror to indicate if they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership" under the Buy Indian Act.
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, UEI SAM Number, Certifying Signature, and Print Name.

This form is critical for any bidder intending to claim status as an "Indian Economic Enterprise" to be eligible for certain contract awards under the Buy Indian Act. Bidders must accurately complete this form and ensure they meet the defined criteria throughout the contract lifecycle. Failure to comply can lead to penalties and disqualification.

Sources Sought Notice

This notice is issued by the Indian Health Service (IHS) to identify potential sources for Medicare Claim Management / Revenue Cycle Management (RCM) Services. It is NOT a solicitation for proposals. The IHS intends to use the Buy Indian Act authority to give preference to Indian Economic Enterprises (IEE) where authorized and practicable.

• NAICS Code: 518210 - Computing Infrastructure Providers, Data Processing, Web Hosting, and Related Services
• Duration: Base Year plus four (4) Option Years

The government is seeking to identify:

• Indian Small Business Economic Enterprises (ISBEEs)
• Indian Economic Enterprises (IEE)
• Any other category of vendor capable of performing the services.

An IEE is a business owned by one or more Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, provided that:

• The combined ownership constitutes not less than 51%.
• The owners must receive at least 51% of the earnings from the contract.
• Management and daily business operations must be controlled by one or more individuals who are Indians.

Vendors interested in this notice must submit a capability statement that includes:

• Number of years of experience in Medicare Claim Management / RCM Services.

• List of past jobs/contracts for Medicare Claim Management / RCM Services.

• A demonstration of how the company meets the IEE definition, specifically addressing:

  • How the prime IEE will receive at least 51% of earnings (or combined with subcontractors).
  • How management and daily operations will be controlled by one or more Indians.
