This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Self-Certification: Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Eligibility Period: The enterprise must meet the definition throughout the offer period, contract award, and the full contract performance period. Any change in eligibility requires immediate notification to the Contracting Officer.
• Required Information: The form requires the Offeror to provide:
  • Name of Federally Recognized Tribal Entity (if applicable)
  • Name of the 51% owner of the IEE Firm
  • Business Name
  • DUNS Number
  • Certifying Signature
  • Print Name
• Legal Consequences: False or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.

Bidders must complete and submit this form to self-certify their status as an Indian Economic Enterprise. Failure to meet the eligibility requirements or provide accurate information may affect their ability to be considered for awards under the Buy Indian Act. Offerors may also be required to provide documentation of eligibility, and successful offerors must be registered with the System of Award Management (SAM).

Sources Sought Notice

This notice is a market research tool to determine compliance with the Buy Indian Act and to assess the feasibility of a set-aside for Indian Economic Enterprises (IEE) or Indian Small Business Economic Enterprises (ISBEE). The Indian Health Service (IHS) is seeking information regarding potential sources for the procurement of two (2) coagulation analyzers, a service agreement, and associated supplies for the Phoenix Indian Medical Center (PIMC) Laboratory Department.

• Two (2) coagulation analyzers.

• Service agreement for the analyzers.

• Supplies for the analyzers.

• The procurement is for new Original Equipment Manufacturers (OEM) medical supplies and equipment, or service contracts for maintenance of medical equipment (including replacement parts). Remanufactured or gray market items will not be accepted.

• The Buy Indian Act will be utilized, giving priority to ISBEE set-asides where possible.

• The response date is January 30, 2026, at 1300 Local Time.

• This is NOT a Request for Quote (RFQ). It is a Sources Sought Notice only.

• Interested firms must provide the following in writing:

  1. Company name.
  2. Point of contact (name, title, phone, email).
  3. FSS / SEWP Contract number (if applicable).
  4. DUNS number or SAM Unique Entity Identifier.
  5. Tax ID number.
  6. Indication of business category (IEE or ISBEE).
  7. A capability statement detailing qualifications and ability to meet the requirement.
  8. Documentation from the manufacturer proving authorization as a distributor (if applicable).

• Vendors must self-certify eligibility on the IHS Indian Economic Enterprise Representation form and identify the Federally Recognized Indian Tribe or Alaska Native Corporation upon which they rely for IEE status.

• Prospective contractors must be registered in SAM and complete electronic annual representations and certifications.

• The IHS will give priority to ISBEE set-asides.

• Firms must qualify as an Indian Economic Enterprise (IEE) or Indian Small Business Economic Enterprise (ISBEE).

  • IEE: Business owned by one or more Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, with at least 51% ownership and control by such entities.
  • ISBEE: An IEE that is also a small business concern.

• Vendors must be an OEM, authorized dealer, authorized distributor, or authorized reseller, verified by OEM documentation.

• Software licensing, warranty, and service must be in accordance with OEM terms and conditions.

• Delivery of gray market items constitutes a breach of contract.
