This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Criteria: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period.
• Notification Requirement: Contractors must immediately notify the Contracting Officer if they no longer meet eligibility requirements.
• Documentation: Contracting Officers may require documentation of eligibility, and awards may be subject to protest.
• Registration: Successful offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law and subject to penalties.
• Representation Section: Bidders must indicate whether they do or do not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, DUNS Number, Certifying Signature, and Print Name.

This form is critical for any bidder seeking to participate in opportunities designated under the Buy Indian Act. Bidders must accurately complete this form to self-certify their eligibility. Failure to meet the criteria or provide accurate information can lead to disqualification or penalties.

Sources Sought Notice

This notice is a Sources Sought for market research to determine compliance with the Buy Indian Act and to aid in the determination of a set-aside for Uninterrupted Power Supply (UPS) systems maintenance and repair services. It is not a Request for Quote (RFQ) or Request for Proposal (RFP).

The government is seeking qualified contractors to provide:

• Annual preventive maintenance for facility, laboratory, and IT UPS systems.
• Semi-annual battery maintenance.
• Battery replacement.
• Emergency repair services for UPS systems. Services must ensure continuous and reliable backup power in accordance with manufacturer recommendations, regulatory requirements, and industry standards.

Not applicable, as this is a Sources Sought notice.

Interested parties must respond in writing, including:

• Company name
• Point of contact (name/title/telephone number/e-mail address)
• FSS / SEWP Contract number (if applicable)
• DUNS number OR SAM Unique Entity Identifier Number
• Tax ID number
• Indication of business category (Indian Economic Enterprise (IEE) or Indian Small Business Economic Enterprise (ISBEE))
• Capability statement addressing qualifications and ability to provide the requirement.
• Documentation from the manufacturer of being an authorized distributor.
• Representation on the designated IHS Indian Economic Enterprise Representation form.
• Identification of the Federally Recognized Indian Tribe or Alaska Native Corporation for IEE status.

Priority will be given to purchases utilizing an ISBEE set-aside to the maximum extent possible, in accordance with the Buy Indian Act. The acquisition of supplies, services, or construction subject to commercial items (FAR 12.209) or Simplified Acquisition Procedures (SAP) (FAR 13.106) must be set-aside exclusively for ISBEEs.
