This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." • Eligibility Criteria: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period.
• Notification Requirement: Contractors must immediately notify the Contracting Officer if they no longer meet eligibility requirements.
• Documentation: Contracting Officers may require documentation of eligibility, and awards may be subject to protest.
• Registration: Successful Offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
• Representation Section: Bidders must indicate whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, DUNS Number, Certifying Signature, and Print Name.

This form is critical for any bidder seeking to qualify for contracts under the Buy Indian Act. Bidders must accurately complete this self-certification to demonstrate their eligibility. Failure to meet the criteria or provide accurate information can lead to disqualification or penalties.

Sources Sought Notice

This notice is a Sources Sought, not a Request for Quote. It is market research to determine compliance with the Buy Indian Act and to assess the possibility of a set-aside for Indian Economic Enterprises (IEE) or Indian Small Business Economic Enterprises (ISBEE).

The government is seeking information regarding a rental agreement to provide a chiller unit capable of supplying 200 Tons of cooling for the Parker Indian Health Center.

• NAICS Code: 238220 (HVAC contractors)
• Response Date: April 10, 2026, 1300 Local Time
• Buy Indian Act: Priority will be given to ISBEE set-asides for supplies, services, or construction subject to commercial items or SAP.
• Definitions:
  • Indian Economic Enterprise (IEE): A business owned by one or more Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, meeting specific ownership, earnings, and management control criteria.
  • Indian Small Business Economic Enterprise (ISBEE): An IEE that is also a small business concern.

Interested firms must provide the following in writing:

1. Company name
2. Point of contact details
3. FSS / SEWP Contract number (if applicable)
4. DUNS number or SAM Unique Entity Identifier
5. Tax ID number
6. Business category qualification (IEE or ISBEE)
7. Capability statement addressing qualifications and ability to meet the requirement.
8. Manufacturer authorization documentation if acting as a distributor (see Attachment 2).

• Firms must complete electronic annual representations and certifications in SAM.
• An IHS Indian Economic Enterprise Representation form must be submitted.
• The procurement is for new OEM medical supplies, equipment, and/or maintenance services. No remanufactured or gray market items will be accepted. Vendors must be authorized distributors/resellers, verified by the OEM.
