This document is the Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form. It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as defined by the Buy Indian Act and HHSAR 326.601. This form is required in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations.

• Eligibility Criteria: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period.
• Notification Requirement: Contractors must immediately notify the Contracting Officer if they no longer meet eligibility requirements.
• Documentation: Contracting Officers may require documentation of eligibility.
• Registration: Successful offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is subject to legal penalties.
• Representation Section: Offerors must indicate whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, DUNS Number, Certifying Signature, and Print Name.

This form is critical for any bidder seeking to be considered under the Buy Indian Act. Bidders must accurately complete and submit this form to self-certify their status as an Indian Economic Enterprise. Failure to meet the eligibility criteria or accurately complete the form may impact the ability to be awarded a contract under this authority.

Sources Sought Notice

This notice is for market research purposes only to determine compliance with the Buy Indian Act and to inform a potential set-aside decision for refuse collection and disposal services. The Indian Health Service (IHS) Contracting Officer will give priority for purchases to Indian Economic Enterprises (IEE) and Indian Small Business Economic Enterprises (ISBEE) to the maximum extent possible.

• The contractor shall provide all labor, equipment, and services necessary for the storage, collection, transportation, and environmentally compliant disposal of solid waste and recyclable materials at the Phoenix Indian Medical Center (PIMC).

• Services must be in accordance with all applicable federal, state, and local regulations.

• This is a Sources Sought Notice, not a Request for Quote (RFQ).

• The Place of Performance is Phoenix Indian Medical Center, Phoenix, AZ.

• Response Date/Time: 5/11/2026 1300 EST.

• Interested firms must respond in writing.

• Required information includes:

  • Company name, point of contact details.
  • FSS / SEWP Contract number (if applicable).
  • DUNS number or SAM Unique Entity Identifier.
  • Tax ID number.
  • Indication of business category (IEE or ISBEE).
  • Capability statement addressing qualifications and ability to provide the requirement.
  • Documentation from manufacturer if an authorized distributor.

• Firms must self-certify eligibility on the designated IHS Indian Economic Enterprise Representation form (Attachment 1).

• Firms must identify the Federally Recognized Indian Tribe or Alaska Native Corporation upon which they rely for IEE status.

• The IHS will prioritize purchases for IEEs and ISBEEs.

• Acquisitions are subject to the Buy Indian Act.

• Acquisitions of supplies, services, or construction that are subject to commercial items (FAR 12.209) or Simplified Acquisition Procedures (SAP) (FAR 13.106) must be set-aside exclusively for ISBEEs.

• Attachment 1: IHS Indian Economic Enterprise Representation form.

• Attachment 2: Statement of Work.

• Prospective contractors must complete electronic annual representations and certifications in SAM.

Statement of Work (SOW) / Performance Work Statement (PWS)

To provide comprehensive solid waste and recyclable materials management services for the Phoenix Indian Medical Center (PIMC), ensuring a safe, clean, and efficient waste management system in compliance with federal, state, and local regulations.

• Comprehensive waste management services including storage, collection, transportation, and disposal of solid waste and recyclable materials.

• Provision and management of various container types: 3-yard, 8-yard, 37-yard trash compactors, and 40-yard roll-off containers.

• Scheduled collections: 3-yard bins twice weekly (Mon/Thu), 8-yard bins five times weekly (Mon-Fri), 37-yard compactors once weekly (Mon/Thu), and 40-yard roll-offs as needed.

• Collection operations must occur between 7 a.m. and 6 p.m.

• Transportation of waste to State of Arizona-approved sanitary landfills.

• Separation and management of recyclable materials.

• Compliance with all applicable federal, state, and local environmental, safety, and health regulations.

• Provision of trained personnel and suitable equipment.

• Web-based systems for tracking, reporting, and communication.

• Reliability, regulatory compliance, and operational efficiency are emphasized.

• Routine reporting to the Contracting Officer's Representative (COR) on collection, disposal, and recycling activities.

• Documentation and recordkeeping for disposal compliance.

• Prompt repair or replacement of damaged equipment.

• Continuous availability of trained personnel.

• Flexible support for unscheduled or emergency collection requests.

• Immediate response to operational issues.

• Weather delay notification within 30 minutes if service cannot proceed.

• Service recovery for missed or delayed services within 24 hours.

• Period of Performance (POP) includes a Base year (09/20/2026 - 09/19/2027) and four Option Years (OY1-OY4) extending to 09/19/2031.

• Services are to be performed at the Phoenix Indian Medical Center (PIMC).

• Contractor must possess a valid solid waste hauler and CDL license in Arizona.

• Compliance with federal (40 CFR Part 257-258), state (AAC Title 18, ARS 49-701 et seq.), and local (City of Phoenix Solid Waste Management Code) regulations.

• Demonstrated experience in commercial/institutional waste management, managing multiple container sizes, and environmentally compliant disposal.

• Evaluation criteria include Technical Capability, Operational Reliability, and Compliance and Reporting.
