• Request Submission: All requests for TDPs must be submitted to the DLA.Aberdeen.SourcesSought@dla.mil inbox within 7 days of the posting date of the SSA/MR request.
• ITAR Controlled: The TDP is subject to International Traffic in Arms Regulations (ITAR). It contains sensitive information that cannot be shared with non-U.S. persons or transferred outside the United States.
• Eligibility Requirements: Companies must have an active status in the Defense Logistics Agency Joint Certification Program (JCP) and possess an approved DD2345.
• Required Documentation: To receive the TDP, companies must submit:
  • A completed and signed Non-Disclosure Agreement (NDA).
  • A copy of the company's DD2345 (JCP).
  • A copy of the company's CAGE verification in SAM.
• NDA Signee and Data Custodian: The NDA signee and the data custodian listed in JCP should be the same individual. Companies must verify and update this information in the JCP Portal if necessary.
• TDP Delivery: Upon verification of JCP status and receipt of the NDA, the TDP will be uploaded to DoD SAFE, and the requester will receive an email with a download link and password.

This document is critical for bidders who require access to the Technical Data Package to understand the full scope and technical details of the opportunity. This document is a Use and Non-Disclosure Agreement (NDA) that the Recipient must agree to in order to receive technical data or computer software from the Government that has restricted rights. It outlines the terms and conditions for the use, modification, reproduction, release, performance, display, or disclosure of such Data.

• Recipient Obligations: The Recipient agrees to use Data marked with government purpose rights or SBIR data rights legends only for government purposes and not for commercial purposes. Data marked with limited rights legends can only be used as specified in the attachment to the Agreement. Computer software marked with restricted rights legends can only be used in response to the referenced Market Survey.
• Protection of Data: The Recipient must implement procedures and security measures to protect the Data from inadvertent release.
• Indemnification: The Recipient agrees to indemnify the Government against claims arising from misuse or unauthorized disclosure of the Data.
• Destruction of Data: The Recipient must destroy the Data and all copies within 30 days after the agreement's effective period ends and notify the Contractor of destruction.

Bidders must understand and agree to the terms of this NDA if they are to receive any restricted technical data or software as part of this opportunity. Failure to comply with the terms of this agreement could result in legal action and financial liability. This document is crucial for understanding the handling requirements of sensitive information provided by the Government.
