• Offeror's Agreement: The Offeror agrees to use the provided Data solely for the preparation of a proposal in response to solicitation N3220527R6002 and for the performance of the resulting contract if awarded.
• Data Restrictions: The Offeror must comply with dissemination restrictions, export controls, and regulations applicable to the Data.
• Confidentiality Controls: The Offeror must establish organizational controls to limit access to the Data and prevent unauthorized disclosure. This includes not copying, releasing, reproducing, distributing, or making the Data available to unauthorized individuals.
• Subcontractor Flow-Down: If subcontractors are involved, the Offeror must identify them and ensure they execute a similar flow-down NDA.
• Return or Destruction: Upon contract award to another entity or completion of work, the Offeror must return or destroy all Data and certify destruction in writing.
• Liability: The Offeror is responsible for costs and damages incurred due to unauthorized disclosure by themselves, their employees, agents, or subcontractors.

This NDA is a mandatory requirement for any Offeror intending to access sensitive technical data related to the USNS ARCTIC (T-AOE 8) for solicitation N3220527R6002. Bidders must understand and agree to these terms to be eligible for proposal preparation and potential contract performance. The agreement requires careful attention to data handling, dissemination, and subcontractor management. Failure to comply can result in significant liability.

Sources Sought Notice

This notice is for market research purposes only and is not a solicitation or request for proposals. Military Sealift Command, Norfolk, is seeking information on potential sources for the Regular Overhaul of the USNS ARCTIC (TAOE 8). The overhaul is anticipated to commence on or about February 8, 2027, and conclude by July 3, 2027, at the contractor's facility. The area of consideration is the East/Gulf Coast. The target date for solicitation issuance is July 14, 2026.

• Displacement Full Load: 49,000 Long Tons
• Draft Full Load: 19 m

• Arrival Draft (ABL) Fwd Mast Top: 24 feet - 5 inches
• Arrival Draft (ABL) Aft Mast Top: 26 feet - 3 inches

Firms capable of performing this work are requested to submit a brief capabilities package demonstrating their ability and experience in performing similar work. The package should include:

1. Company Profile: Number of employees, office location(s), UEI number, CAGE Code, and small business designation/status.
2. Facility Description: Location and description of the facility where the work will be performed.
3. Business Size: Indicate if your company is a large or small business and its socioeconomic category (HUBZone, SDVOSB, WOSB, etc.), if applicable. This procurement will be solicited under NAICS Code 336611 (Ship Building and Repair) with a size standard of 1,300 employees.
4. Partnerships: Information on any partnerships, teaming, joint ventures, or mentor-protégé agreements.
