This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Requirements: The enterprise must meet the definition of "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period. Any changes in eligibility must be immediately reported to the Contracting Officer.
• Representation: Offerors must indicate whether they represent that their entity does or does not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership" under the Buy Indian Act.
• Required Information: The form requires the Offeror to provide:
  • Name of Federally Recognized Tribal Entity (if applicable)
  • Name of the 51% owner of the IEE Firm
  • Business Name
  • DUNS Number
  • Certifying Signature
  • Print Name

This form is critical for bidders responding to opportunities that are set aside or sole-sourced under the Buy Indian Act. Failure to meet the eligibility requirements or accurately complete this form can lead to disqualification or penalties. Bidders must ensure they meet the definition of an "Indian Economic Enterprise" and be prepared to provide documentation if requested. Successful offerors must also be registered with the System of Award Management (SAM).

Solicitation / RFP / RFQ

This is a Sources Sought Notice to conduct market research for bulk medical gases delivery and cylinder rental services for the Health and Human Services (HHS), Indian Health Service (IHS), Whiteriver Service Unit (WRSU). The services include delivery, transport, return rental of medical gas cylinders, and procurement of bulk liquid medical oxygen.

• Delivery, transport, and return rental of medical gas cylinders.

• Procurement of bulk liquid medical oxygen.

• Services must be provided by an OEM, authorized dealer, distributor, or reseller, with OEM warranty and service maintained.

• No remanufactured or gray market items will be accepted.

• The contract officer will give priority for purchases utilizing ISBEE set-aside to the maximum extent possible.

• This is a Sources Sought Notice, not a Request for Quote.

• Interested firms must respond in writing by 04/14/2026, 1300 Local Time.

• Responses must include company name, point of contact, FSS/SEWP contract number (if applicable), DUNS/SAM Unique Entity Identifier, Tax ID, business category (IEE or ISBEE), and a capability statement.

• Firms must self-certify eligibility on the designated IHS Indian Economic Enterprise Representation form.

• Prospective contractors must be registered in the Systems for Award Management (SAM).

• The acquisition is subject to the Buy Indian Act.

• Priority will be given to Indian Small Business Economic Enterprises (ISBEEs).

• Firms must qualify as an Indian Economic Enterprise (IEE) or Indian Small Business Economic Enterprise (ISBEE).
