This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Requirements: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period. Any change in eligibility requires immediate written notification to the Contracting Officer.
• Documentation: Contracting Officers may require documentation of eligibility. Successful Offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is a violation of law and punishable under 18 U.S.C. 1001. False claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
• Representation Section: Offerors must indicate whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Fields: Name of Federally Recognized Tribal Entity, Name of the 51% owner of IEE Firm, Business Name, DUNS Number, Certifying Signature, and Print Name.

This form is critical for any bidder seeking to participate in opportunities designated for or requiring compliance with the Buy Indian Act. Bidders must accurately complete this form to self-certify their eligibility. Failure to meet the criteria or accurately represent the business's status can lead to disqualification or penalties.

Sources Sought Notice

This notice is a market research tool to determine compliance with the Buy Indian Act and to assess the availability of Indian Economic Enterprises (IEE) and Indian Small Business Economic Enterprises (ISBEE) for a requirement. It is not a Request for Quote (RFQ).

The government is seeking to procure comprehensive chemical water treatment services for the Whiteriver Indian Health Service Unit (WRSU) at the Power Plant's cooling system and heating systems.

Interested firms must respond in writing by 06/22/2026, 1300 Local Time. Responses must include:

• Company name
• Point of contact information
• FSS/SEWP Contract number (if applicable)
• DUNS number or SAM Unique Entity Identifier
• Tax ID number
• Indication of business category (IEE or ISBEE)
• Capability statement addressing qualifications and ability to provide the services
• Documentation from manufacturer (if an authorized distributor)
• Completed IHS Indian Economic Enterprise Representation form
• Identification of the Federally Recognized Indian Tribe or Alaska Native Corporation for IEE status.

The IHS Contracting Officer will give priority for purchases to ISBEEs under the Buy Indian Act. Acquisitions subject to commercial items or SAP must be set-aside exclusively for ISBEES. The notice seeks to identify responsible IEE/ISBEEs.

This is the only notice; no other copies will be provided. Prospective contractors must be registered in SAM. The government will use responses to make an acquisition decision.
