This solicitation is for an Indefinite Delivery/Indefinite Quantity (IDIQ) contract for the U.S. Customs and Border Protection (CBP) to provide delivery and distribution of meals and other services. The acquisition will be conducted using FAR Part 12 and 15, with class deviations applied.

• Delivery and distribution of meals and other services as specified in the attached Statement of Work (SOW).

• Services will be provided to four regional U.S. Border Patrol (USBP) locations: San Diego Sector, El Paso Sector, Rio Grande Valley Sector, and Miami Sector.

• Task orders will utilize a combination of Firm, Fixed Price (FFP) and/or Fixed Unit Pricing (FUP).

• Pricing sheets are attached for proposal pricing.

• Contract Type: Single-award IDIQ.

• Ordering Period: 5 years from the date of award.

• Minimum Government Guarantee: $15,000.00.

  • Region 1 (San Diego Sector): $8,000,000.00
  • Region 2 (El Paso Sector): $32,500,000.00

• Technical and Management Approach is more important than Past Performance, and both combined are equal to Price.

Statement of Work (SOW) / Performance Work Statement (PWS)

This Statement of Work (SOW) outlines the requirements for providing meals, delivery, and distribution services to migrants temporarily held by U.S. Customs and Border Protection (CBP) at various U.S. Border Patrol (USBP) locations throughout the Southern Border (SB) area of operations.

• The contractor shall furnish all equipment, materials, labor, resources, and supervision for meal preparation, delivery, distribution, and clean-up services.

• Locations operate 24/7, and services must be dynamic and flexible to accommodate a constantly changing migrant population.

• All food must meet current USDA and FDA health standards, including Federal, State, and County regulations.

• Meals must be obtained from licensed sources, prepared in licensed locations, and transported to prevent microbial growth.

• Food handlers must comply with applicable health laws and regulations.

• Meal plans/menus must be developed in consultation with a registered nutritionist/dietitian, ensuring age-appropriate nutritional standards, variety, and palatability.

• The estimated average meals required per location can range from 10 to 3000 per meal period (breakfast, lunch, dinner), potentially increasing to over 5000 per meal period during higher apprehension rates.

• Standard meal delivery and distribution periods are between 6:00 AM and 6:00 PM, with exceptions for late arrivals as outlined in Task Orders.

• Meals must meet USDA and FDA nutritional guidelines, with specific requirements for Tender Age Children (2-12), Older Children (13-17), and Adults (18+).

• Two of the three daily meals must contain a hot entrée.

• Menus must accommodate diverse/restricted diets (e.g., vegetarian, gluten-free, pork-free).

• Food must be in edible condition and not frozen, expired, or spoiled.

• Food and water shall not be used as a reward or withheld as punishment.

• Two of the three daily meals must be delivered and/or served hot.

• Contractor must provide a Food Safety Plan/Quality Control Plan with their proposal.

• The contract is an Indefinite Delivery Indefinite Quantity (IDIQ) with a 5-year ordering period.

• Performance locations are within four USBP Sectors: San Diego, El Paso, Rio Grande Valley, and Miami.

• Specific location details and distribution services will be specified in individual Task Orders.

• A current favorable background investigation (BI) is required for all personnel working on the contract.

• Contractor personnel must be immediately removed if derogatory information is discovered.

• Contractor must comply with PREA (Prevent, Detect, and Respond to Sexual Abuse and Assault in Confinement Facilities) requirements.

• Services must be provided during all Federal Holidays and weekends.

• The contract includes specific requirements related to the Flores Settlement Agreement for facilities in the Rio Grande Valley and El Paso Sectors, focusing on the treatment of juveniles.

• Deliverables include a Food Safety Plan/Quality Control Plan, Quarterly Sales Activity Reports, and current business health certifications.

This questionnaire is to be completed by the customer of the offeror's past projects. Bidders should ensure their past performance references are aware of this requirement and are prepared to provide detailed and positive feedback. The responses will directly impact the evaluation of the offeror's past performance, a key factor in determining their ability to be awarded the contract.
