Justification and Approval (J&A)

This document justifies the award of a purchase order on a sole source basis to GEA Mechanical, the Original Equipment Manufacturer (OEM), for complete oily water separator bowl sets for the USNS ROBERT E. PEARY (T-AKE 5). This procurement is necessary to ensure the vessel maintains operational status and can complete its missions.

• Complete bowl sets for the oily water purifier system.

• These are critical equipment parts essential for the vessel's operation and readiness.

• The procurement will be funded utilizing fiscal year 2026 Operations and Maintenance, Navy (O&M, N) funds.

• The anticipated cost is determined to be fair and reasonable.

• The government intends to post a pre-solicitation notice with this justification.

• Award will be a firm-fixed-price purchase order to GEA Mechanical Engineering upon submission of a technically acceptable quote.

• This action is being taken under 10 U.S.C. 3204(a)(1) due to a brand name requirement.

• MSC perpetually seeks submissions from non-OEM contractors for qualification of their parts and/or services as acceptable alternatives to the OEM.

• GEA Mechanical is the only vendor with access to the required drawings, manuals, and technical knowledge.

• Using OEM Authorized Source parts ensures the vessel maintains operational status and meets technical requirements.

• Failure to procure these parts could lead to a C-4 status (CASREP 4) for the oily water purification system, preventing the vessel from sailing.

• MSC is directed to only use OEM parts on this equipment aboard MSC Fleet Vessels per COMSCINST 4490.4.

• Regulatory bodies like the U.S. Coast Guard and ABS only recognize servicing and repairs by an authorized OEM representative.

• MSC does not have the data rights for these parts, thus cannot provide proprietary information to other competitors.

• MSC has no plans at this time to allow for non-OEM suppliers in future contracts for these supplies, but will assess future competition if new sources emerge.
