This document incorporates by reference various Federal Acquisition Regulation (FAR) and Commerce Acquisition Regulation (CAR) provisions and clauses. It also provides the full text for FAR 52.12-4 (Terms and Conditions—Commercial Products and Commercial Services) and other specific provisions and clauses relevant to the solicitation.

• FAR 52.12-4 (Full Text): Details terms and conditions for commercial products and services, including definitions, inspection/acceptance, assignment, changes, disputes, excusable delays, invoicing, patent indemnity, payment terms, risk of loss, taxes, termination (convenience and cause), title, warranty, limitation of liability, compliance with unique government contract laws, order of precedence, unauthorized obligations, and Comptroller General examination of records.

• FAR 52.225-4 (Buy American—Free Trade Agreements—Israeli Trade Act Certificate): Requires offerors to certify the origin of end products and identify any foreign end products or domestic end products with critical components.

• FAR 52.225-18 (Place of Manufacture): Requires offerors to indicate the predominant place of manufacture for end products for statistical purposes.

• FAR 52.240-90 (Security Prohibitions and Exclusions): Requires representations and certifications regarding covered telecommunications equipment/services, FASCSA orders, Sudan business operations, and Iran sanctions.

• CAR 1352.233-70 & 1352.233-71: Outlines procedures for filing agency, GAO, and Court of Federal Claims protests, including service requirements.

• CAR 1352.246-70 (Place of Acceptance): Specifies the National Institute of Standards and Technology (NIST) in Gaithersburg, MD, as the place of acceptance.

• NIST LOCAL-53: Provides guidance on contract performance during changes in NIST operating status, including checking campus status daily and procedures during appropriation lapses.

• Billing Instructions: Requires electronic invoice submissions via email to INVOICE@NIST.GOV and through the Invoice Processing Platform (IPP).

• Offerors must complete and submit required representations and certifications, including those related to Buy American, Place of Manufacture, and Security Prohibitions.

• Invoices must be submitted electronically via email and IPP, with specific required information.

• Offerors are cautioned that listed provisions may require completion and submission with their offer.

Solicitation / RFP / RFQ

This is a combined synopsis/solicitation for commercial products or services, issued as a Request for Quotation (RFQ) under full and open competition. The acquisition is for specific ion pumps and controllers as detailed in the attached Statement of Work.

• CLIN 0001: 200 L/s ion pump (3 Each)

• CLIN 0002: 400 L/s ion pump (1 Each)

• CLIN 0003: Differential ion pump (1 Each)

• CLIN 0004: 4 section ion pump controller (1 Each)

• CLIN 0005: High-current ion pump controller (1 Each)

• Detailed requirements are in the attached Statement of Work.

• Delivery, acceptance, and FOB point are specified in the Statement of Work.

• Contract type: Firm-fixed-price.

• Solicitation Number: 1333ND26QNB030132.

• Provisions and clauses are current through Federal Acquisition Circular (FAC) 2025-06 and the Revolutionary FAR Overhaul (RFO).

• Submission Deadline: Electronic quotations due by 12:00 PM Eastern Time, April 8, 2026.

• Submission Method: Email to elizabeth.timberlake@Nist.gov with a copy to tracy.retterer@nist.gov. Reference RFQ number in the subject line.

• Quotation Structure: Must be divided into three volumes: Volume I – Technical Quotation, Volume II – Price Quotation, Volume III – Terms and Conditions.

• Technical Volume: Must include technical descriptions, product literature documenting specifications, country of origin, manufacturer authorization (if applicable), and confirmation of delivery, installation, training, and warranty capabilities.

• Price Volume: Must include solicitation number, point of contact details, Unique Entity Identifier, firm fixed price per line item and total, shipping/delivery costs, and discount terms.

• Terms and Conditions Volume: Complete required information from attached provisions and clauses.

• Evaluation Criteria: Award will be made to the lowest priced, technically acceptable offeror. Technical capability will be evaluated based on submitted documentation demonstrating compliance with or exceeding minimum requirements. Prices will be evaluated for reasonableness.

• Award Basis: Award may be made without discussions based solely on initial quotes.

• Inquiries: Submit questions in writing to both email addresses listed above no later than 2 business days from posting. Responses will be provided in an amendment.

• Small Business Size Standard: 1,000 employees.

• Offerors must have an ACTIVE registration in SAM.gov at the time of quotation submission, award, performance, and final payment.

• This procurement is not under GSA FSS or GWAC.

• If quoting under an FSS/GWAC, the terms and conditions of this solicitation will apply to the resultant purchase order.

Statement of Work (SOW) / Performance Work Statement (PWS)

This SOW details the requirements for vacuum pumps and controllers necessary for the CHIPS project's new synchrotron beamline at SURF III. This beamline is critical for a dedicated radiometry and detector calibration facility supporting the semiconductor industry. The vacuum pumps are essential for achieving and maintaining ultra-high vacuum conditions (10-10 torr or lower) required for the beamline's operation.

The contractor shall provide new equipment, including:

• Ion Pumps:
  • Three (3) Gamma Vacuum P/N 200L-CV-8S-SC-110-N (or equivalent), 200 L/s pumping speed, 10-11 torr ultimate pressure.
  • One (1) Gamma Vacuum P/N 400L-CV-8S-SC-110-N (or equivalent), 400 L/s pumping speed, 10-11 torr ultimate pressure.
  • One (1) Gamma Vacuum P/N XW-CV-2D-SC-110-N (or equivalent), Differential Ion pump, 10-11 torr ultimate pressure.
• Pump Controllers:
  • One (1) Gamma Vacuum P/N QPC-4-P-S-1-US110-S-S-N (or equivalent), 4-section controller.
  • One (1) Gamma Vacuum P/N MPCQ-2-P-S-1-US110-S-S-N (or equivalent), High-current controller.

All items must be new, in original manufacturer packaging with documentation. "Gray market" components are not acceptable.

• Pumps must achieve starting pressures of 10-4 torr or greater and ultimate pressures of 10-11 torr or less.

• Controllers must be capable of controlling the specified Gamma Vacuum pumps.

• Cybersecurity and privacy requirements consistent with federal laws and NIST standards (e.g., FISMA, SP 800-171) must be met, including a system security plan, secure configuration baselines, access controls, vulnerability scanning, and encryption.

• Deliverables Due: No later than 12 weeks after receipt of order.

• Place of Performance: NIST Gaithersburg, MD.

• Warranty: Minimum 1 year from acceptance (per FAR 52.212-4).

• Payment: 100% after installation, acceptance, and successful completion of testing and demonstration by the TPOC.

• Delivery Terms: F.O.B. Destination to NIST Gaithersburg.

• Inspection & Acceptance: NIST will inspect and may perform tests within 14 days of receipt. Government reserves the right to reject nonconforming equipment.
