Quick Summary

The US Army Corps of Engineers, New Orleans District, intends to award a sole source contract to Building Control Systems, L.L.C. for Warehouse 3 HVAC Replacement. This Special Notice is a Total Small Business Set-Aside under NAICS 238220. Firms believing they can meet the requirements must submit written notification by May 1, 2026, at 11:00 AM local time.

Purpose

This notice announces the government's intent to award a noncompetitive, Firm-Fixed-Priced (FFP) definitive contract to Building Control Systems, L.L.C. (CAGE: 31YX6) for the replacement of the HVAC system in Warehouse 3 at the USACE New Orleans District headquarters campus. This decision is based on a justification for other than full and open competition, citing substantial duplication of cost if procured competitively.

Scope of Work

The project involves upgrading the HVAC system in Warehouse 3. The contractor will:

  • Install six new 4-ton Energy Star Certified heat pump split systems.
  • Suspend units above the ceiling and duct them with flex to control humidity and space temperature.
  • Set condensers on the side of the building.

Contract Details

  • Type: Sole Source (Notice of Intent)
  • Intended Awardee: Building Control Systems, L.L.C.
  • Set-Aside: Total Small Business (FAR 19.5)
  • NAICS: 238220 - Plumbing, Heating, and Air-Conditioning Contractors (Small Business Size Standard: $19.0M)
  • PSC: J041 - Maintenance, Repair and Rebuilding of Equipment: Refrigeration, Air Conditioning, and Air Circulating Equipment
  • Place of Performance: USACE New Orleans District Facility, 7400 Leake Avenue, New Orleans, LA 70118
  • Period of Performance: April 15, 2026, through July 15, 2026

Justification for Sole Source

Market research and a Justification and Approval (J&A) determined that Building Control Systems, L.L.C. is the only responsible source. BCS installed the current HVAC system in January 2007 and has performed all subsequent maintenance and repairs. The government lacks plans or drawings of the existing system, making BCS's nearly 20 years of unique knowledge crucial to avoid complications, escalated costs, and significant investigation. Alternative approaches, including other small business set-asides, were deemed not feasible due to these specialized requirements.

Response Instructions & Deadline

This notice is not a request for competitive quotes. However, any firm that believes it can meet the requirements may submit written notification with supporting evidence to demonstrate their ability to perform. Responses will be evaluated, but the government's determination not to compete is at its sole discretion. If no responses are received, the government will proceed with the sole source award. Responses are due by May 1, 2026, at 11:00 AM local time, and must be submitted via email to Taylor.H.Brandon@usace.army.mil. Telephone requests or inquiries will not be accepted.
