This document outlines the Terms of Use Agreement required for accessing technical documents and Government Furnished Information (GFI) related to Request for Proposal N0002426R6222. Bidders must execute this agreement to receive sensitive data.

• Data Usage Restrictions: The agreement details how "Data" (technical documents and GFI) can be used solely for generating questions, comments, and proposals related to the RFP.
• Distribution Statements: Recipients must adhere to specific distribution statements, markings, and guidance on each document.
• Security Clearance: A SECRET Security Clearance is required.
• Handling and Disclosure: The Data is property of the U.S. Government and controlled under NISPOM. Copying is permitted for internal company distribution only. Distribution outside the company requires written permission. Disclosure to unauthorized individuals, foreign nationals, or outside the U.S. territory is prohibited without a valid Technical Assistance Agreement (TAA)/Export License.
• Record Keeping: Bidders must maintain a log of all produced copies, distribution, and destruction dates.
• Destruction: Originals and copies must be destroyed no later than 180 days after the RFP closes, unless a subsequent solicitation is issued and a proposal is planned. Certification of destruction is required within 30 days of contract award in that scenario.
• Acknowledgement: The agreement must be acknowledged and accepted by the Facility Security Officer.
• Required Information: Bidders must provide company details including Business Name, UEI, CAGE Code, Business Address, Mailing Address, Facility Clearance Level, and Storage Capability Level.

Execution of this agreement and adherence to its terms are mandatory prerequisites for receiving critical technical data necessary to prepare a compliant proposal for RFP N0002426R6222. Bidders must ensure they meet the security clearance and data handling requirements.
