Scope of Work
Selected Offeror(s) will lease DA land to develop commercial data centers. Key responsibilities include:
- Full Project Lifecycle: Designing, financing, permitting, developing, constructing, installing, owning, maintaining, operating, and decommissioning the data center(s).
- Self-Sufficiency: Projects must be viable without any monetary or other contributions from the DA.
- Compliance: Adherence to all applicable federal, state, and local laws, codes, ordinances, and regulations, including environmental (e.g., NEPA, CERCLA, RCRA) and building codes.
- Infrastructure: Provision of utilities, access roads, parking, and physical security at the Offeror's sole cost. Police, fire, and EMS services will be reimbursable.
- Due Diligence: Offerors must conduct their own due diligence on property conditions and legal requirements.
- Decommissioning: A decommissioning bond will be required, and properties must be restored to their original condition upon EUL expiration.
Contract Details
- Contract Type: Enhanced Use Lease (EUL). This is a real estate transaction, not an acquisition of goods or services, and is not governed by the FAR.
- Lease Term: Fifty (50) years, with a potential option for renewal if proposed by the Offeror.
- Consideration: In-kind, cash, or a combination thereof, not less than the fair market value of the lease interest as determined by DA. DA prefers in-kind consideration.
- Set-Aside: None specified.
Submission & Evaluation
- Proposal Submission Deadline: February 23, 2026, 5:00 P.M. (EST). Each proposed project (even if by the same Offeror for multiple sites) should be submitted as its own proposal.
- Questions Deadline: February 13, 2026, 5:00 P.M. (EST).
- Evaluation Factors: Proposals will be evaluated based on five equally weighted factors: Project Description, Project Plan, Financial Capability, Organizational Structure/Experience/Past Performance, and EUL Consideration (Rent).
- Award: DA may award one or more EULs and reserves the right to negotiate, modify, or cancel the RFP. Award will be based on best overall value.
Eligibility
- Entities must be organized under U.S. laws, have majority domestic ownership and control, and a physical place of business in the U.S.
- Ineligible entities include those debarred, suspended, on the Excluded Parties List System, posing security risks, or subject to felony indictment.
