Scope of Work
The contractor will provide direct legal representation to "NQRP Respondents" nationwide. Services encompass proceedings prior to a final administrative order, such as removal, deportation, asylum, bond, and appeals before the Board of Immigration Appeals (BIA). Specific legal services include initial case assessment, evaluation of safeguards, representation at hearings, repatriation/release planning, and various forms of relief (e.g., termination, voluntary departure, adjustment of status). Excluded services are litigation before federal district courts, circuit courts of appeals, or the Supreme Court.
Performance Requirements
Qualified Representatives must be licensed attorneys, supervised law students/graduates, or DOJ Accredited Representatives, authorized to practice before Immigration Courts and the BIA. Key performance standards include:
- Timely entry of appearance (e.g., 35, 21, or 15 calendar days for Franco NQRP Respondents; 35 calendar days for Nationwide Policy NQRP Respondents).
- 100% completion of initial case assessments and client meetings.
- 95% timely filing of appearances and error-free motions.
- 100% representation at immigration court hearings.
- 90% of repatriation/release plans meeting specifications.
- 100% compliance with confidentiality and ethical standards.
- Submission of a Program Operation Plan (POP) and monthly progress reports. The estimated caseload includes 600-800 carry-over cases and 300-400 new cases annually, with an average of 100 hours per case.
Contract Details
- Contract Type: Firm Fixed Price.
- Period of Performance: A 12-month base period (anticipated August 1, 2026 – July 31, 2027) with four 12-month option periods, potentially extending through July 31, 2031. The government may also extend services for up to six months.
- Place of Performance: Nationwide, including various ICE detention facilities and EOIR immigration courts across the U.S.
