Contract Details

Both T-BOS and S-BOS contracts are envisioned as Indefinite Delivery, Indefinite Quantity (IDIQ) vehicles, primarily with Firm-Fixed-Price (FFP) CLINs, supplemented by Cost-Reimbursable CLINs for materials, travel, and unscheduled work. The anticipated duration for S-BOS is a 3-year base with four 12-month options (7 years total), and for T-BOS, a 3-year base with two 12-month options (5 years total), reflecting Türkiye's economic risks.

A critical aspect for both locations is the mandatory inheritance of the incumbent workforce and adherence to Collective Labor Agreements (CLAs). Spain's CLA includes fixed wage increases and comprehensive fringe benefits, while Türkiye's CLA mandates semi-annual wage increases tied to the Consumer Price Index, creating significant inflation and currency fluctuation risks. To mitigate this, the Government has developed a unique "H-1, Combined Labor and Currency Clause" (C-LAC) for Türkiye, designed to share risk and provide budget stability. Additionally, a draft H-Clause outlines liquidated damages for Key Personnel vacancies, with penalties up to $1,200 per day for critical roles.

Anticipated Evaluation

Draft evaluation criteria indicate a Best-Value Tradeoff source selection process. Technical factors will be significantly more important than Price. Past Performance will be evaluated on an Acceptable/Unacceptable basis, requiring 2-5 recent and relevant contracts ($20M+ annual value, multi-function BOS, OCONUS experience). Technical subfactors include Program Leadership/Staffing & Continuity and Performance Oversight & Technology. Price will be evaluated for reasonableness, balance, and realism, considering mandatory labor and severance costs.
